Houston and Chicago Law Firm Files Wrongful Death Lawsuit against Boeing on Behalf of Victim Killed in 737 MAX Aircraft Fatal Crash in Ethiopia

HOUSTON, TEXAS April 5, 2019. Attorneys, Nomaan Husain of Husain Law + Associates, Floyd Wisner of The Wisner Law Firm, and Omar Khawaja of The Law Offices of Omar Khawaja filed a lawsuit today on behalf of U.S. Citizen Mucaad Hussein Abdalla, who was a passenger of Ethiopian Air Flight 302 (“ET 302”). Mr. Abdalla was one of 157 passengers killed in the devastating plane crash of a Boeing 737 MAX 8 aircraft on March 10, 2019.
The lawsuit was filed in federal district court in Chicago against Boeing, the manufacturer of the 737 MAX 8 aircraft, based in Chicago, Illinois and Rosemount Aerospace, Inc. of Delaware, a component manufacturer of the 737 Max 8. The complaint alleges that, among other causes of action, Boeing and Rosemount Aerospace failed to properly inform aircraft pilots of the dangers and risks presented by its new software system for flight control.
On Thursday, April 4, 2019, Boeing admitted that the software system of the aircraft had a role in not only the March 10th fatal Ethiopian plane crash but was also the cause of a prior fatal Lion Air plane crash in Indonesia in October 2018. “We’re taking a comprehensive, disciplined approach, and taking the time, to get the software update right,” said Boeing CEO Dennis Muilenburg in a recently published statement.
The company’s failure to properly inform the pilots of the defective flight control system left the pilot with no ability to restore manual control of the aircraft. “It’s our responsibility to eliminate this risk. We own it and we know how to do it,” stated Muilenburg. Preliminary reports indicate that the Boeing aircraft involved in the Lion Air crash demonstrated malfunctions after take-off and that the aircraft manual also failed to contain any information on how the control the aircraft for this type of malfunction. Boeing’s failure to warn the pilots of this known risk was irresponsible. Further, it has created an ongoing tragedy for the victims of Boeing’s negligent conduct.
Mucaad Hussein Abdalla was well-loved among his family and recently married. His brother Hassan Abdi stated, “He was social and generous and we miss him dearly. He had a long life ahead of him and he was taken away from us too soon.”
Attorney Nomaan Husain stated, “Once again corporate greed has prioritized profits over safety with tragic consequences for the public. Our goal with this lawsuit is to obtain answers for our grieving clients and hold those accountable for this preventable tragedy.”
The aircraft involved in the crash was manufactured and delivered approximately 4 months before the tragedy occurred. The lawsuit seeks to recover damages caused by the wrongful death of the passengers on the Boeing manufactured aircraft.
Attorney Omar Khawaja added, “We are demanding answers from Boeing, Rosemount, and any other company which led to the defective design and release of this aircraft which should not have been in the air at the time of this accident.”
